User Agreement

This User Agreement and Terms of Service (the “Terms”) constitute a binding contract between you and COMMUNITY FIRST CREDIT (“we,” “us,” or “our”) governing your access to and use of the kopalaini mobile application and its related services (collectively, the “Services”).

Before using kopalaini, carefully review these Terms together with the kopalaini Privacy Policy. Your creation of an account, submission of an application, or use of any Service confirms that you have read, understood, and accepted this agreement. If these provisions are unacceptable to you, do not access or use the Services.

1. The Contracting Parties

The Services are provided by COMMUNITY FIRST CREDIT, located at Rujewa Street, Opposite Lutheran Church, Mbeya, Mbeya, Tanzania. You may contact us by telephone at +255 0793908166 or by email at allyjida39@gmail.com.

2. Who Is Allowed to Use kopalaini

You are permitted to use the Services only when you are at least 18 years old, have the legal capacity to enter into a binding agreement, reside in a place where the Services may lawfully be offered, provide accurate, complete, and current information, and use only a telephone number, bank account, mobile-money account, or other account that you are legally authorised to use.

We can ask you to provide evidence of your identity, age, residence, authority, income, employment, or eligibility. We can decline, limit, or end the Services where verification cannot be completed or where doing so is required by applicable law or regulation.

3. Opening and Protecting an Account

All information supplied by you must be truthful, accurate, complete, and up to date when registering for and using the Services. Any change to that information must be reflected in your account promptly. You must not create an account for another person, impersonate another person, or submit false, altered, stolen, or misleading information or documents.

You are responsible for safeguarding your device, password, PIN, authentication token, and one-time password. You must never disclose an OTP or permit another person to operate your account. You must notify us promptly if your device or credentials are lost, stolen, compromised, or used without your permission.

If unusual activity is identified, or if fraud, misuse, unauthorised access, or a security threat is reasonably suspected, we may suspend access, request further verification, delay a transaction, or restrict the account.

4. What the Services Provide

kopalaini may allow eligible users to register an account, complete identity verification, provide financial and employment information, submit a loan or credit application, receive an assessment or decision, receive funds, make repayments, and obtain customer support.

Neither installing the application, registering an account, nor lodging an application means that you are guaranteed approval, any particular loan amount, interest rate, fee, repayment period, disbursement time, or continued availability of the Services. Applications may be assessed according to applicable eligibility, affordability, fraud-prevention, credit-risk, and regulatory requirements.

If a loan or credit product is approved, its specific terms will be presented in a separate loan agreement or product disclosure before you accept the offer. If the product-specific agreement conflicts with these Terms on a matter relating to that product, the product-specific agreement will control that matter.

5. Verification, Compliance, and Credit Review

Subject to applicable law and the kopalaini Privacy Policy, you authorise us to verify information you submit and to obtain relevant information from identity-verification providers, banks, payment partners, mobile-money providers, licensed credit bureaus, telecommunications operators, public records, fraud-prevention providers, and competent authorities.

These checks may include KYC, AML/CFT, sanctions, politically exposed person, identity, affordability, repayment-capacity, creditworthiness, device-risk, and fraud screening. Information described in the Privacy Policy may be used in credit scoring and risk assessment.

You confirm that every document and item of information you submit is genuine and relates to you. If information cannot be verified or appears inaccurate, fraudulent, or misleading, we may reject an application, limit the Services, report suspected unlawful activity, or take another action permitted by law.

6. Loan Offers, Charges, and Acceptance

Before you accept a loan or credit product, we will present the material terms required by applicable law. These terms may include the principal amount, applicable interest, fees, taxes or charges, total amount payable, payment schedule, due dates, consequences of late or missed payment, and any cancellation or early-repayment rights.

You should review every offer carefully before accepting it. You will not be bound by a particular offer until you complete the required acceptance process. We will not charge a fee that has not been disclosed. Available amounts, interest, fees, limits, and repayment periods may vary according to the product, applicable law, risk assessment, and information available when the offer is made.

7. Receiving Funds and Making Payments

Approved funds may be transferred to a bank account or mobile-money account designated and verified through the Services. You are responsible for making sure that the destination information is correct and that you are authorised to use the relevant account.

You must repay all amounts due in the manner and by the dates stated in the applicable loan or product agreement. You authorise us and our payment partners to process payment instructions that you validly approve. Processing time may depend on banks, mobile-money operators, telecommunications networks, and other providers outside our control.

If you believe that a payment or disbursement is incorrect, you must contact us promptly and provide the information reasonably required to investigate the matter.

8. Overdue Amounts and Collection Activity

Late or missed payment may result in charges that were disclosed and are permitted by law, restrictions on access to further Services, lawful collection activity, and reporting to a licensed credit bureau where such reporting is permitted.

We and our authorised partners will conduct collection activities in accordance with applicable law. You must not be threatened, harassed, publicly shamed, misled, or subjected to abusive collection practices. You should contact us promptly if you are experiencing financial difficulty or believe that collection conduct is inappropriate.

9. Device Access and Personal Information

Some features may request access to the camera, a manually selected emergency contact, financial SMS messages, installed-application information, device and system information, approximate location, or other information described in the kopalaini Privacy Policy. A permission request will explain the relevant purpose. You may manage device permissions through your device settings, although disabling a necessary permission may prevent the related feature from operating.

Our collection, use, storage, sharing, and protection of personal data is governed by the kopalaini Privacy Policy. If you provide another person's emergency contact information, you confirm that you are authorised to provide that information.

10. Rules for Using the Services

Use of the Services is restricted to lawful purposes. The following conduct is prohibited:

  • Violate any law, regulation, court order, or third-party right.
  • Provide false information or forged, altered, stolen, or misleading documents.
  • Impersonate another person or open or operate an account without authority.
  • Use the Services for fraud, money laundering, terrorist financing, unlawful lending, or another illegal activity.
  • Interfere with security, attempt unauthorised access, introduce malicious code, or disrupt the Services.
  • Reverse engineer, decompile, scrape, copy, resell, or exploit the Services except where applicable law expressly permits it.
  • Manipulate a device, location, application, transaction, identity signal, or other information to deceive a security or risk-control system.
  • Use automated systems to access the Services without our written permission.
  • Assist another person in carrying out any prohibited activity.

11. Service-Related Communications

You agree that we may use the contact details you provide to send operational communications relating to identity verification, applications, decisions, account security, payments, repayment reminders, account changes, customer support, and legal notices.

We will send marketing communications only where permitted by applicable law and, where consent is required, after obtaining your consent. You may withdraw that consent or opt out of marketing without affecting essential service communications.

12. External Providers and Services

The Services may depend on banks, mobile-money providers, telecommunications operators, identity-verification providers, application stores, credit bureaus, cloud-service providers, and other third parties. Their own terms and privacy policies may apply to services that they provide independently.

We are not responsible for an independent third party's acts, omissions, availability, or content, except where applicable law does not allow us to exclude responsibility.

13. Ownership and Permitted Use

The Services, including the software, interface, text, graphics, trademarks, logos, models, and other content, belong to us or our licensors and are protected by applicable intellectual-property laws.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable licence to install and use the application solely for its intended lawful purpose. No ownership rights are transferred to you.

You retain ownership of content that you lawfully submit. You grant us a limited right to host, reproduce, process, and transmit that content only as reasonably necessary to provide and protect the Services, comply with law, and exercise our rights under these Terms and the Privacy Policy.

14. Availability, Updates, and Operational Changes

We may maintain, modify, update, suspend, or discontinue a feature. We aim to provide reliable Services but do not guarantee uninterrupted, error-free, or continuously available operation. Maintenance, network failure, third-party services, force majeure, or other events outside our reasonable control may affect availability.

We may require you to install an update for security, legal, performance, or compatibility reasons. Where reasonably practicable, we will notify you of material changes.

15. Restriction, Closure, and Termination

You can discontinue use of the Services whenever you choose and may request closure of your account. Closing an account does not cancel an outstanding loan, payment obligation, investigation, dispute, or legal recordkeeping requirement.

We may suspend, restrict, or terminate access where reasonably necessary to protect you, us, another user, or the Services; investigate suspected fraud, illegality, security compromise, or breach of these Terms; comply with a legal or regulatory requirement; address non-payment under a product agreement; or discontinue all or part of the Services.

Where reasonably practicable and lawful, we will provide notice and an opportunity to resolve the relevant issue. Terms that by their nature should continue after termination will remain effective, including payment obligations, intellectual-property provisions, liability provisions, dispute provisions, and lawful data-retention requirements.

16. Service Disclaimers

To the maximum extent permitted by law, the Services are provided on an “as available” basis. We do not promise that every application will be approved, that you will receive a particular amount or offer, or that use of the Services will improve your credit profile. Information provided through the application does not constitute independent financial, tax, or legal advice.

Nothing in these Terms excludes a warranty, consumer protection, legal duty, or remedy that cannot lawfully be excluded.

17. Limits on Responsibility

As far as applicable law allows, we are not liable for indirect, incidental, special, punitive, or consequential loss, or for loss caused by an unauthorised third party, inaccurate information supplied by you, your failure to protect account credentials, or a third-party network or payment system outside our reasonable control.

This section does not exclude or limit liability for fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of a mandatory data-protection duty, or another liability that cannot lawfully be excluded or limited.

18. Responsibility for Loss Caused by Misconduct

To the extent permitted by law, you agree to compensate us for reasonable loss, liability, and cost arising directly from your fraud, intentional unlawful conduct, material breach of these Terms, or violation of another person's rights. This provision does not apply to loss caused by us or where consumer law prohibits it.

19. Complaints and Resolution of Disputes

Please contact us first so that we can attempt to resolve a complaint promptly. You may contact COMMUNITY FIRST CREDIT at the address, telephone number, or email address set out below.

Nothing in these Terms prevents you from submitting a complaint to a competent financial-services, consumer-protection, data-protection, regulatory, or judicial authority, or from exercising a legal right that cannot be waived.

20. Applicable Law and Courts

The interpretation and enforcement of this agreement are governed by the laws of the United Republic of Tanzania. Subject to any mandatory consumer right or statutory complaint process, disputes may be submitted to the competent courts of Tanzania.

21. Amendments to This Agreement

This agreement may be updated by us to reflect changes in law, the Services, security requirements, or our business practices. We will publish the updated Terms and revise the effective date. Where required by law, we will provide additional notice before a material change takes effect or request your renewed agreement.

22. Remaining Contract Terms

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in effect, and the affected provision will be applied to the maximum extent permitted by law. Our failure to enforce a provision does not waive it.

You may not transfer your rights or obligations under these Terms without our consent. We may transfer our rights or obligations as part of a lawful reorganisation, financing, or business transfer, subject to applicable safeguards.

These Terms, the kopalaini Privacy Policy, and any applicable loan or product agreement form the relevant agreement between you and us concerning the Services.
